This product no longer exists. PermitScope withdrew the "property-intelligence pack" ("Leads") product on 2026-09-03. These terms govern only a purchase of that retired product made before that date. If you are looking at a current market-intelligence report, these terms do not apply to you. See the current Terms of Sale instead.

1. Lead use restrictions: no TCPA consent

Leads are explicitly NOT TCPA-consented. Buyer may contact property owners by manual dialing only. No automatic telephone dialing system (ATDS), no prerecorded or artificial voice, and no SMS/text contact without Buyer first obtaining the recipient's prior express consent as required by 47 U.S.C. § 227 and its regulations.

3. Indemnification

Buyer shall indemnify, defend, and hold harmless PermitScope and its owner from and against any claim, demand, action, or proceeding arising from Buyer's use of the Leads, including without limitation claims under the TCPA, any state mini-TCPA, or any unfair-or-deceptive-acts-and-practices (UDAP) statute, and including reasonable attorneys' fees, settlements, and judgments. This obligation survives termination or completion of any purchase.

4. Audit right

Upon thirty (30) days' written notice, PermitScope may audit Buyer's call records, consent-capture mechanisms, DNC scrub logs, and CRM records relating to Leads purchased, solely to verify compliance with these terms.

5. Non-agency

Buyer is not an agent, employee, partner, joint venturer, or representative of PermitScope, and has no actual or apparent authority to act for or bind PermitScope in any respect. Buyer's contacts with property owners are made solely on Buyer's own behalf.

If Buyer operates in any of the following states, Buyer additionally represents that it complies with: the Florida Telephone Solicitation Act (FTSA, including its broader autodialer definition); the Oklahoma Telephone Solicitation Act (including 2-year consent-record retention); the Washington Commercial Electronic Mail Act (CEMA, acknowledging statutory damages of $500 per violation); the Maryland Stop the Spam Calls Act; and Texas SB 140 (including its text-message coverage).

8. Not a consumer report: no FCRA use

Leads and Reports are not consumer reports under the Fair Credit Reporting Act (15 U.S.C. § 1681). Buyer shall not use them, in whole or in part, to determine any person's eligibility for credit, insurance, employment, housing or tenancy, or for any other "permissible purpose" under 15 U.S.C. § 1681b. Buyer shall indemnify PermitScope for any FCRA claim arising from Buyer's misuse.

10. Nature of the product; exclusivity; refunds

Reports are curated public-records research: a propensity-based targeting list, not pre-qualified leads and never a guarantee of work. Every property fact cites its public-records source; verify on-site before bidding. Exclusivity holds are as stated on the pack itself (paid packs: no other contractor in the same trade receives the same properties for the stated window). If inventory moves between checkout and composition, the undelivered portion is refunded automatically.

11. Disclaimer of warranties

EVERYTHING PERMITSCOPE SUPPLIES IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law, PermitScope disclaims all warranties, express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy, completeness, currency, or non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, PermitScope's total aggregate liability arising out of or relating to these terms, the Leads, or any purchase shall not exceed the total amount Buyer actually paid PermitScope in the twelve (12) months preceding the event giving rise to the claim, and PermitScope shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for lost profits. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or personal injury caused by negligence.

13. Time limit for claims

Any claim arising out of or relating to these terms or any purchase must be brought within one (1) year after the claim arose, or it is permanently barred, except where applicable law forbids shortening the limitation period.

14. Governing law and venue

These terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is a state or federal court located in Wisconsin, and both parties consent to that jurisdiction. If any provision is held unenforceable, it is modified to the minimum extent necessary to make it enforceable, and the remainder stays in effect.
